These Terms of Use ("Terms") govern your access to and use of the ReelTimes Fishing mobile application ("App"), which is operated by REELTIMES ANALYTICS LLC ("Company," "we," "us," or "our").

By downloading, installing, accessing, or using the App, you agree to be bound by these Terms and our Privacy Policy. These Terms also incorporate Apple's applicable terms and conditions, including the Apple End User License Agreement (EULA), available through Apple's services.

If you do not agree to these Terms, do not download, access, or use the App.

1. ACCEPTANCE OF TERMS

By using ReelTimes Fishing, you acknowledge that you have read, understood, and agree to these Terms.

If you use the App on behalf of another person or entity, you represent that you have authority to accept these Terms on their behalf.

We may update these Terms from time to time. Your continued use of the App after updated Terms become effective constitutes acceptance of the revised Terms.

2. DESCRIPTION OF THE APP

ReelTimes Fishing provides weather, marine, tide, environmental, and fishing-related information, insights, forecasts, reports, ratings, and other content intended for informational and recreational purposes.

The App may incorporate information from third-party sources, including governmental agencies, weather services, marine data providers, tide stations, buoys, APIs, and other public or commercial data sources.

The Company does not guarantee that information provided through the App is accurate, complete, current, or suitable for any particular purpose.

3. SUBSCRIPTIONS AND BILLING

ReelTimes Fishing may offer subscription-based access to certain premium features or content.

Subscriptions purchased through the App are processed through Apple's App Store and may be managed through third-party subscription-management services, including RevenueCat.

The Company does not directly receive or store your complete payment-card information.

Subscriptions may automatically renew unless canceled in accordance with the applicable App Store subscription terms.

You may manage or cancel your subscription through your Apple App Store account.

Refunds and certain subscription-related matters are governed by Apple's applicable policies and terms.

4. WEATHER, MARINE, FISHING, SAFETY AND LEGAL DISCLAIMER

ReelTimes Fishing is an informational tool and is not a substitute for official weather, marine, navigational, emergency, or safety information.

Weather, tide, wind, swell, water temperature, atmospheric conditions, fishing activity, species forecasts, and other environmental information can change rapidly and may contain errors, omissions, delays, or inaccuracies.

The App's fishing ratings, forecasts, scores, recommendations, and other analytical outputs are estimates generated using available data and methodologies. They are not guarantees that fish will be present, that fishing conditions will be favorable, that specific species or types of fish are legally in season or permitted to be fished/caught, or that any particular species will be caught.

Users are solely responsible for determining whether conditions are safe and appropriate for fishing, boating, navigation, swimming, or any other activity and that fish are legally permitted to be fished.

Before engaging in any activity affected by weather or marine conditions, users should consult appropriate official sources, including applicable government weather and marine authorities, and use their own judgment.

Never rely solely on ReelTimes Fishing for decisions involving personal safety, navigation, legal severe weather, or emergency conditions.

5. NO WARRANTIES

THE APP AND ALL CONTENT, INFORMATION, DATA, REPORTS, FORECASTS, RATINGS, FEATURES, AND SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, REELTIMES ANALYTICS LLC DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, RELIABILITY, AVAILABILITY, AND NON-INFRINGEMENT.

REELTIMES ANALYTICS LLC DOES NOT WARRANT THAT:

  • Information provided by the App will be accurate or complete;

  • Forecasts or fishing predictions will be correct;

  • Data will be current or available without interruption;

  • The App will operate without errors or interruptions;

  • The App will be available at any particular time or location;

  • Any particular fish species will be present or caught;

  • The App will produce any particular fishing, financial, competitive, or recreational result.

Third-party data sources may experience outages, delays, inaccuracies, technical failures, or changes in availability without notice.

6. USER-SUBMITTED CONTENT

ReelTimes Fishing may allow users to voluntarily submit photographs, catch information, captions, comments, species information, catch measurements, fishing locations, and other materials through the App ("User Content").

You retain ownership of User Content that you submit. However, by submitting User Content through the App, you grant REELTIMES ANALYTICS LLC a non-exclusive, worldwide, royalty-free, transferable, sublicensable license to host, store, reproduce, modify, edit, adapt, publish, display, distribute, transmit, and otherwise use the User Content for purposes related to the operation, promotion, marketing, advertising, and development of ReelTimes Fishing and the Company's business.

This license includes the right to use User Content on social media platforms, websites, advertisements, promotional materials, marketing campaigns, and other public-facing channels.

The Company may crop, resize, edit, format, caption, combine, or otherwise modify User Content for these purposes.

You understand that User Content submitted to the App may be publicly displayed or shared by the Company.

Your Responsibility for User Content

By submitting User Content, you represent and warrant that:

  • You own the content or otherwise have all rights necessary to submit it;

  • Your submission does not infringe another person's intellectual-property, privacy, publicity, or other rights;

  • You have permission from any identifiable person appearing in a photograph or other submission when such permission is legally required;

  • Your submission does not contain unlawful, defamatory, threatening, obscene, fraudulent, or otherwise prohibited material;

  • You have not knowingly submitted another person's private or confidential information without authorization.

You should not submit sensitive personal information, passwords, financial information, or other confidential information through the App.

The Company does not guarantee that submitted User Content will be published or retained.

REELTIMES ANALYTICS LLC reserves the right, but not the obligation, to review, moderate, refuse, remove, edit, or decline to publish any User Content at its sole discretion.

7. LOCATION INFORMATION IN USER CONTENT

Users may voluntarily provide general information regarding where a catch occurred.

Users should avoid submitting precise private-location information if they do not want that information publicly disclosed.

The Company may use general catch-location information in connection with User Content, including for reports, rankings, social-media posts, marketing, and other App-related purposes.

The Company may remove or obscure certain location information before publicly displaying User Content when it determines that doing so is appropriate.

Users should be aware that photographs may contain embedded metadata, including location information, depending on the device and manner in which the photograph was created or submitted.

8. INTELLECTUAL PROPERTY

The ReelTimes Fishing App and its original content, features, functionality, designs, graphics, branding, logos, reports, scoring methodologies, analytical systems, text, software, and other materials are owned by or licensed to REELTIMES ANALYTICS LLC and are protected by applicable intellectual-property laws.

Except as expressly permitted by these Terms or applicable law, you may not:

  • Copy or reproduce App content;

  • Redistribute or commercially exploit App content;

  • Modify or create derivative works from the App;

  • Reverse engineer or attempt to extract source code from the App;

  • Scrape or systematically collect App data;

  • Republish App reports or forecasts without permission;

  • Use Company branding or trademarks without written permission.

"ReelTimes Fishing" and related Company branding may constitute trademarks or other proprietary marks of REELTIMES ANALYTICS LLC.

9. THIRD-PARTY SERVICES AND DATA

ReelTimes Fishing may rely upon or integrate with third-party services, including:

  • Apple App Store services;

  • RevenueCat;

  • NOAA;

  • National Weather Service (NWS);

  • NOAA tide and marine data services;

  • Buoy and environmental data providers;

  • Other governmental, public, commercial, or third-party APIs and data sources.

Third-party services are subject to their own terms, conditions, privacy policies, availability, and limitations.

REELTIMES ANALYTICS LLC is not responsible for the accuracy, availability, reliability, or continued operation of third-party services or data sources.

10. BACKEND SYSTEMS AND SOFTWARE

ReelTimes Fishing operates proprietary backend systems that may use third-party software, APIs, open-source libraries, databases, cloud infrastructure, and other technologies.

Certain backend components may be subject to applicable open-source licenses or third-party terms.

These backend systems are used to operate and support the App and are not necessarily distributed directly to users.

11. USER RESPONSIBILITY

You are responsible for your own decisions and actions when using information provided by ReelTimes Fishing.

You agree to:

  • Verify weather and marine conditions before engaging in activities;

  • Follow applicable laws and regulations;

  • Follow applicable boating, fishing, navigation, and safety requirements;

  • Obtain any required licenses or permits;

  • Exercise appropriate caution and judgment;

  • Avoid relying solely on App information for safety-critical decisions.

REELTIMES ANALYTICS LLC does not assume responsibility for your decisions or actions based on information obtained through the App.

12. LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, REELTIMES ANALYTICS LLC AND ITS MEMBERS, OFFICERS, EMPLOYEES, CONTRACTORS, AFFILIATES, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO YOUR USE OF, OR INABILITY TO USE, THE APP.

THIS INCLUDES, WITHOUT LIMITATION:

  • PERSONAL INJURY OR DEATH;

  • PROPERTY DAMAGE;

  • LOSS OF PROFITS OR REVENUE;

  • LOSS OF DATA;

  • MISSED FISHING OR SPORTING COMPETITION RESULTS;

  • LEGAL PENALTIES FROM FAILURE TO ABIDE MY FEDERAL, STATE, OR LOCAL LAW 

  • LOSS ARISING FROM INACCURATE OR DELAYED INFORMATION;

  • WEATHER OR MARINE-RELATED EVENTS;

  • APP OR SERVICE INTERRUPTIONS;

  • THIRD-PARTY SERVICE FAILURES;

  • DECISIONS MADE IN RELIANCE ON APP CONTENT.

TO THE FULLEST EXTENT PERMITTED BY LAW, THE COMPANY'S TOTAL LIABILITY ARISING OUT OF OR RELATED TO THE APP SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO THE COMPANY FOR THE APP OR RELATED SERVICES DURING THE TWELVE MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) $100.

Some jurisdictions do not allow certain limitations of liability, so some of the above limitations may not apply to you.

13. SERVICE MODIFICATIONS AND DISCONTINUATION

REELTIMES ANALYTICS LLC reserves the right to modify, suspend, restrict, or discontinue the App or any portion of its features, content, subscriptions, data sources, or services at any time, with or without notice.

The Company is not obligated to maintain any particular feature, data source, subscription offering, or functionality indefinitely.

14. TERMINATION

REELTIMES ANALYTICS LLC may suspend or terminate your access to the App if you violate these Terms, misuse the App, infringe the rights of others, attempt to interfere with the operation of the App, or engage in conduct that the Company reasonably determines may harm the Company, the App, or its users.

​

Upon termination, provisions of these Terms that by their nature should survive termination will remain in effect, including provisions concerning intellectual property, User Content, disclaimers, limitations of liability, and governing law.

15. PRIVACY

Your use of ReelTimes Fishing is also governed by the Company's Privacy Policy.

The App may collect or process information necessary to operate its features, manage subscriptions, maintain services, and process voluntarily submitted User Content.

The Company's Privacy Policy describes applicable data practices in greater detail.

16. GOVERNING LAW

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict-of-law principles, except to the extent federal law applies.

Any dispute arising out of or relating to these Terms or the App shall be brought in a court of competent jurisdiction in the State of Florida, unless applicable law requires otherwise.

17. SEVERABILITY

If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, that provision shall be enforced to the fullest extent permitted by law, and the remaining provisions shall remain in full force and effect.

​

18. ENTIRE AGREEMENT

These Terms, together with the Privacy Policy and any other applicable terms expressly incorporated by reference, constitute the entire agreement between you and REELTIMES ANALYTICS LLC regarding your use of ReelTimes Fishing and supersede prior agreements concerning the same subject matter.
